Terms of Use

1. Agreement to Terms

Welcome to StoryBaze! These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and StoryBaze ("Company," "we," "us," or "our") governing your access to and use of the StoryBaze mobile application, website (storybaze.com), and all related services (collectively, the "Services"). By creating an account, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines, which are incorporated herein by reference. If you do not agree to these Terms, you must not access or use our Services. We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the Services or via email. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.

2. Eligibility and Account Registration

2.1 Age Requirements

You must be at least 13 years old (or the applicable age of digital consent in your jurisdiction) to create an account and use our Services. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. Access to mature content (content rated 18+) is restricted to users who are at least 18 years old and have enabled mature content in their account settings. We may require age verification for access to such content.

2.2 Account Creation

To access certain features of our Services, you must register for an account. During the preview period, registration requires a valid invite code. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password confidential and secure
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access or security breach
  • Not create multiple accounts for deceptive purposes

2.3 Account Termination

You may delete your account at any time through the app settings. We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion, with or without notice.

3. Use of Services

3.1 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal, non-commercial enjoyment and, if you are an author, for creating and publishing content on our platform.

3.2 Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the Services in any way that violates any applicable law or regulation
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation
  • Interfere with or disrupt the Services or servers/networks connected to the Services
  • Attempt to gain unauthorized access to any part of the Services
  • Use any robot, spider, scraper, or automated means to access the Services
  • Collect or harvest user data without consent
  • Transmit any viruses, malware, or other harmful code
  • Circumvent any technological measures we use to protect the Services
  • Reverse engineer, decompile, or disassemble any aspect of the Services

3.3 AI Voice Narration

StoryBaze offers AI-powered voice narration powered by ElevenLabs. By using this feature, you acknowledge that:

  • Story content is processed by third-party AI services to generate audio
  • Voice output is generated by AI and may not perfectly replicate human speech
  • We may select voice styles and apply enhancements to improve the listening experience
  • Usage of AI narration may be subject to additional terms from our AI provider

4. User-Generated Content

4.1 Your Content

Our Services allow you to create, upload, publish, and share content including stories, chapters, short stories ("Whispers"), comments, ratings, reviews, and profile information (collectively, "User Content"). You are solely responsible for your User Content and the consequences of posting it.

4.2 Content Ownership

You retain all ownership rights in your User Content. By submitting User Content to StoryBaze, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your User Content in connection with operating and providing our Services. This license includes the right to:

  • Display your stories to readers on our platform
  • Convert your written content to audio using AI voice synthesis
  • Use excerpts for promotional purposes with attribution
  • Allow readers to share content through built-in sharing features
  • Create backups and archives for operational purposes This license ends when you delete your User Content or your account, except where your content has been shared with others and they have not deleted it, or where retention is required for legal purposes.

4.3 Content Guidelines

You represent and warrant that your User Content:

  • Is your original creation or you have the right to submit it
  • Does not infringe any third party's intellectual property rights
  • Does not violate any applicable law or these Terms
  • Is accurately classified for age-appropriateness (18+ content must be marked as such)
  • Does not contain illegal content, including child sexual abuse material
  • Does not promote hatred, violence, discrimination, or illegal activities
  • Does not contain personal information of others without their consent

4.4 Content Moderation

We use a combination of AI-powered automated moderation and human review to ensure content compliance. We reserve the right to:

  • Review, screen, and moderate User Content before or after publication
  • Remove or disable access to content that violates these Terms or our Community Guidelines
  • Reject content during review without obligation to explain
  • Issue warnings, restrictions, or strikes for content violations
  • Report illegal content to appropriate authorities

4.5 Strike System

Violations of our content guidelines may result in strikes against your account. The consequences escalate with each strike:

  • 1st Strike: Warning notification
  • 2nd Strike: Temporary commenting restriction
  • 3rd Strike: Temporary story posting restriction
  • 4th Strike: Account suspension
  • 5th Strike: Permanent account ban Severe violations may result in immediate escalated action, including permanent bans without prior strikes.

5. Author Program and Monetization

5.1 Becoming an Author

Registered users may apply to become authors on StoryBaze. Approval is at our sole discretion. Authors can publish stories, build an audience, and potentially earn money through our monetization features.

5.2 Author Earnings

Authors may earn revenue through multiple channels on StoryBaze, including:

  • Paid Content Unlocks: When readers spend coins to unlock eligible premium stories, chapters, or SBits
  • Coin Tips: When readers tip you with coins
  • Premium and Program Revenue: Eligible revenue allocated under StoryBaze Premium, SBits, or other approved monetization programs Earnings are calculated based on platform rules in effect at the time and are subject to change with notice. We reserve the right to adjust earnings calculations and payout schedules.

5.3 Withdrawals

Accumulated eligible earnings above the minimum threshold can be withdrawn to a supported, verified payout method, currently bank payout where available. Withdrawal processing may take up to 14 business days. We may require identity verification (KYC) before processing withdrawals. We reserve the right to withhold earnings if we suspect fraud, Terms violations, or for tax compliance purposes. Earnings may be forfeited if your account is terminated for violations.

5.4 Taxes

You are solely responsible for all taxes related to your earnings from StoryBaze. We may be required to collect tax information and report earnings to tax authorities in accordance with applicable laws. You agree to provide accurate tax information upon request.

6. Purchases, Coins, and Subscriptions

6.1 In-App Purchases

StoryBaze offers various in-app purchases including coin packages and subscription plans. Purchases for digital goods in the StoryBaze mobile app, including coin packages and Premium subscriptions, are processed through the applicable app store platform, such as Apple App Store in-app purchase or Google Play Billing.

6.2 StoryBaze Coins

Coins are a virtual currency used within StoryBaze to access premium content, tip authors, unlock features, and make other in-app transactions. Important terms regarding coins:

  • Coins are purchased with real currency and are non-refundable
  • Coins have no monetary value outside the StoryBaze platform
  • Coins cannot be exchanged for cash or transferred between accounts
  • Unused coins may expire if your account is inactive for 12+ months
  • We reserve the right to modify coin values, uses, and availability
  • Coin balances are not guaranteed and may be adjusted for service errors

6.3 Subscriptions

Subscriptions provide access to premium features or author content on a recurring basis. Subscription terms:

  • Subscriptions automatically renew at the end of each billing period
  • You may cancel anytime through your account settings or app store
  • Cancellation takes effect at the end of the current billing period
  • Refunds for subscriptions are handled according to app store policies
  • Subscription prices may change with 30 days advance notice

6.4 Refund Policy

All purchases are generally non-refundable. Refund requests may be considered on a case-by-case basis for:

  • Technical errors that prevented delivery of purchased items
  • Unauthorized transactions (subject to investigation)
  • Other circumstances at our discretion For purchases made through app stores, refund requests must be submitted to the respective app store according to their policies.

7. Intellectual Property Rights

7.1 Our Intellectual Property

The StoryBaze name, logo, branding, and all content, features, and functionality of our Services (excluding User Content) are owned by StoryBaze and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without our express written permission.

7.2 Copyright Infringement

We respect intellectual property rights and expect our users to do the same. If you believe content on StoryBaze infringes your copyright, please submit a DMCA takedown notice to: Email: copyright@storybaze.com Subject: DMCA Takedown Request Your notice must include:

  • Identification of the copyrighted work claimed to be infringed
  • Identification of the infringing material and its location on our Services
  • Your contact information (name, address, email, phone)
  • A statement that you have a good faith belief the use is not authorized
  • A statement under penalty of perjury that the information is accurate
  • Your physical or electronic signature Repeat infringers may have their accounts terminated.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our Services, you agree to the collection and use of information in accordance with our Privacy Policy.

9. Disclaimers and Limitations of Liability

9.1 Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND FREEDOM FROM VIRUSES OR OTHER HARMFUL CODE. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses. We do not guarantee the accuracy, completeness, or usefulness of any content. Any reliance on User Content is at your own risk.

9.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL STORYBAZE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. Our total liability for any claim arising out of or relating to these Terms or Services shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

9.3 Third-Party Content

We are not responsible for User Content or any third-party content, products, or services linked to or available through our Services. User Content represents the views of its authors, not StoryBaze.

10. Indemnification

You agree to defend, indemnify, and hold harmless StoryBaze and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

  • Your use of the Services
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your violation of any applicable law

11. Dispute Resolution

11.1 Informal Resolution

Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at legal@storybaze.com. We will attempt to resolve the dispute within 60 days.

11.2 Arbitration Agreement

If informal resolution fails, any dispute arising from or relating to these Terms or Services shall be settled by binding arbitration, except that you may bring claims in small claims court if they qualify. The arbitration shall be conducted in accordance with the rules of the American Arbitration Association.

11.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION. You waive the right to participate in class actions, class arbitrations, or representative actions.

11.4 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

12. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and StoryBaze regarding the Services. Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Assignment: You may not assign or transfer your rights under these Terms without our consent. We may assign our rights and obligations without restriction. Force Majeure: We shall not be liable for any failure or delay resulting from circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or government actions. Headings: The headings in these Terms are for convenience only and do not affect interpretation.
